    NBDad's Big List of Links...aka the separation checklist

    There has been mention several times on the forums about "I wish there was a checklist out there so I knew things I needed to do when we separated".

    I've compiled a bunch of links that I find myself using over and over again, feel free to add anything that comes to mind.

    1. Read THE LIST. It's a scarily accurate depiction of a nasty separation and what MIGHT happen. Take the necessary steps to protect yourself and your children.

    2. Buy a PVR (Personal Voice Recorder)...it may or may not be admissible as evidence, but at least it will stop any false DV (Domestic Violence) charges. Wear it on your person at ALL times.

    3. File form RC65 with the CRA after 90 days of separation. This cements the actual date of separation and makes it easier to avoid issues caused by ambiguous dates.

    4. File a new CCTB/UCCB application with CRA no later than 90 days post separation, include as much supporting documentation as you can to reflect the new custody arrangements.

    5. In the absence of a court order, calculate and start paying AT LEAST offset amounts of CS beginning 90 days after you separate. Do it via email money transfer or cheque (ensuring to utilize the MEMO field to document EXACTLY what the check is for..ie. Child support for MM/YYYY).

    This ensures you get credit for any monies paid (you WILL have to pay this out eventually if you are the higher income earner, may as well avoid arrears).

    Alternately, if you are trying to force settlement, OR are dealing with a batshit crazy ex, don't pay anything. Set an amount aside each month in a separate account equal to full tables of CS. In the event you lose and are nailed for RETRO Child Support....you have it already on hand. Yes, it's a prick move...but unfortunately some people only understand monetary consequences.

    6. Educate yourself about other similar cases. CanLII has a wealth of information.

    7. If you believe the ex to be a flight risk, especially to the US...then call and have the children flagged in their system. Alternately if the children have Passports, you can call and have the passports flagged in the system.
