  • FRO not applying payments to arrears

    Requested and received a statement of arrears from the FRO. Requested one because by my calculations arrears should be almost paid off, few more payments left.

    I was utterly SHOCKED to see that since Nov 2009 they have not applied any arrears payments to arrears. And it seems that after 3 years of the FRO correctly applying the arrears payments they somehow have no recollection of the court order, and have been diverting all the payments to our other case with them. We are currently getting all the paperwork in order to file a motion to change to deal with arrears from my husband's oldest child.

    How can they just lose the court order, well they don't say lost they now say it never existed. What do we do now? I am trying to help my husband through this, and have no idea where to turn now or what to do.

    What are the options?

    As for the Court Order, if you do not have a copy, you can go down to the courthouse and ask for a copy and fax FRO a copy explaining everything in detail.
    I also found a lawyer that deals with FRO and issues. Other option contact Ombudsman.

      I do have a copy of the court order. And will fax it to them, with details. Is it as simple as that to have them correct the situation? I'm thinking it is harder. And what about all of those payments they didn't apply to the arrears will they fix that too?

        They have a complaint process that you may want to use.

          You cannot do anything to fix their error, although you should ask for your case worker's name, their supervisor's name, and then contact the Director via mail with a complaint. Then contact the Ombudsman if you do not here back from FRO on a resolution. Also, introduce this in court, as it shows the error after 3 years of correct application, and may sway the court by showing you are trying to fix the matter.

            I will call to obtain that information. On a good day it is hard to even get to speak with a live person on the phone.
            I am very new to the whole family court system, but how do i go about introducing this in court? Do I file a motion?

              Here is a link to the Canadian Children's Rights Council article and contact details for complaints to or about the FRO. I am not sure how up to date it is, but it is good to check out the site.
