  • I think I'm being spied on.

    I don't know if my husband is lurking here on this forum, but here goes. I know he has seen a lawyer, supposedly to start the separation process. A couple of days ago, I found in his trash can, an empty box for a voice recorder. It can record for 200 hours and is voice and noise sensitive. I feel so scared, afraid to have conversation in the home for fear he has hidden it somewhere. Please, what do I do now? Can he do this?

    Ask him about it. It probably has to be connected to the wall jack for the phone, unless it's a sophisticated spying device, so check all your phone jacks in the house.

          Honestly, if you aren't doing anything wrong then I wouldn't worry about it. Don't give him anything to use against you or let him goad you into an argument. Be polite and courteous regardless of his demeanor and you could even try the 'killing him with kindness' route until it drives him to frustration and he gives up spying on you. Make your personal or sensitive calls away from home if you have to but really, if you have nothing to hide then I wouldn't worry too much about it at all.

            A person can record any conversation that they are a participant of. If he is talking to you, he can record the conversation without telling you.

            He may not record you when he is not present. If he is within earshot and can hear it himself, he is allowed to record it.

            If he is not within earshot, he may not record it, it is an invasion of your privacy, and it certainly would not be admissible in court. Canada is nowhere near as strick about recordings as the US is. As long as he is present, he doesn't have to tell you he is recording anything.

            He may not record your phone conversations with other people. He may record his phone conversations with you, or any kind of conference call as long as everyone else knows he is on the line.

            If he happens to record you and you are agreeing to something verbally, this is rarely binding on you. At best he may use it to show he was trying to make reasonable offers to settle with you.

            He is likely just using the recorder to protect himself against the possibility you or someone else accuses him of assault or abuse.

            You should consult a lawyer to confirm everything I am explaining to you.

                To be honest, I wish I'd thought of getting one of those myself. It would have been a good investment. I can think of at least $1000 worth of legal hassles that would have been cleared up instantly if I'd had a couple of conversations recorded.

                    my ex recorded my phone conversations. He was charged with interception of communications because he was recording all my phone conversations. he was also found guilty of it.

                          If he is spying on you it is against the law to record your conversation with other people and he can't record anything that you are not aware of except 1 on 1 conversation with you.

                          If I believed there is a 200 hour long recorder hidden in my house I would contact the police or my lawyer.

                              Thanks everyone for your replies. We live in a moderately small home with our son, so there are few private places to be. It is a terrible feeling! Where has he hidden this gadget? I realize he says things to me or our son to try to start up anger in me and I'm not taking the bait. I'm trying to be cool. It is time for me to find a lawyer.
