  • Unfair enrichment

In the past 10 years, roughly since we had bought the matrimonial home, in total, I have earned approximately $800,000. In the same time period, she is self employed, had no income when she was pregnant (I supported her) and made approximately $200,000. The matrimonial home was bought for $135,000 and is now worth around $300,000 after many upgrades and added out-buildings.

We were, of course, common-law. Is there a case for me here to claim unfair enrichment on her part? And if so, exactly when does that come in to play?

    Heart-broken dad,

Is the home jointly owned or individually owned?

If individually owned, I think they have the onus to prove unjust enrichment.
