  • Served with a 14B Motion Form

Hey everyone - I am in the middle of a motion to change case that I started and the respondent in that case has gone ahead and served me with a 14B Motion Form asking the court for an order to extend our separation agreement until our child reaches the age of 25. Currently it says age of 21 but i know that doesnt really matter since he is 20 now and in the middle of a program at Mohawk College. She seems to think that I will not be providing support after he turns 21 which is not true.

Anyway my question is what form do i need to fill out to respond to this ?

She put in her motion that it was made with notice to all persons involved - oppostion expected, when i did not get any notice other that it showing up in my mailbox.

Seems I only have 4 days to respond otherwise it will be treated as unopposed ?

Also would it be an appropriate response to say that I am willing to extend the agreement until the child finishes his first degree ?

There is some talk about our son going on to McMaster University once he is done at Mohawk but i believe the standard length of CS is until the child finishes one degree, is it not ?

Thanks for any help you can offer !

Do not agree to anything. At least not until you get in front of a judge. Considering you are already scheduled for a settlement conference that includes the extra years of school, the ex may be off her rocker.

    Other key points:
    1. Parties have appeared before a judge for a conference but the judge ordered the other party to produce detailed receipts and documents on kids school expenses, loans and employment income. These were provided but include a multitude of expenses that are not eligible.
    2. Parties were scheduled for a settlement conference but it was delayed due to COVID. Now scheduled for September.
    3. Other party has requested that the existing agreement be extended to age 25.
    4. There are no guarantees kid will continue on to second program.

I have a feeling this is simply a hail mary attempt on her part. Especially since it doesn’t have a date!
