  • Can I register any activities under my parenting time?

    My ex does not allow me to register any sports activities under my parenting time unless she agreed in advanced. Of course that 8 out of 10 times she did not agree on it even when I offered that I won't claim S7 expense.

    You only need permission if you expect the parent to pay. If the activity is on your time and you are paying the full cost, register them, no permission needed.

            You can ask for permission to get a portion but if they say no (and they are within their rights to do) and you still want to register kid, its your dime.

                  There are 100's of thousands of children who don't have extracurricular activities. They are "extracurricular" and not "special" nor are they "extraordinary".

                    Mandatory section 7 is daycare, medical and school. Some sports are section 7 like kids who have been playing for years or kids who are young and starting out etc. Its a case by case basis but if its t-ball at $50-75 for the season, not s7. If its soccer theyve been playing for a few years and $500, s7.

                      • Extraordinary stuff is S7 (as in, kid is going to be an NHL star)
                      • Judges routinely screw up when it comes to determining if an expense is S7. Rulings are all over the map.
                      I would ask for consent, and then file it when she says no, and register kid anyway (and pay for it). Do that a bunch of times. If you want to go to court, you probably want to have about 4-5 refusals for every time that she says yes.

                        If the children enjoy it, and you can afford it then just go for it. And don't let the EX use the SA as a means of controlling you and the kids.

                        The judge at my CC told me that swimming lessons were a Section 7 expense, because in Ontario we have so many lakes and rivers that the threat of drowning if not prepared was too great.
