    my husbands ex wife has always called the shots per say..they have never had any court order written up for child support and all has gone very well in the past..the ex has repeatedly told my husband how "fair" she has always been regarding the support...we don't pay to the guidelines (almost by not quite) so a week or so ago (after a flair up of hers) she decided that she wanted to up the support to the guidelines and also wanted retro active payment for the past year of $1200..my question is she entitled to ask and then get this from us considering the fact that she waited until now to ask for it?? my husband being the nice guy that he is will pay her however he is thinking only of paying her according to the guidelines of prior May 2006...I must add that this child never gets any new clothes and has to wear the hand me downs of his older sister and older brother..the poor kid has no snow pants to wear etc etc etc....thanks for any advise

    She can ask for it, it is difficult to say whether the court will grant same.

    However, child support is the right of the child and a reasonable stance would be guideline amount. Usually courts will order retro activity up to the date of application on same. ie: Previous to the application it wasn't an issue.

    It is unfortunate that this is occurring, but not much can be done - There is no accountability on how child support is spent. As the child ages,the child will see for themselves and remember that they got the hand me downs - contrary to that parent receiving child support for same. Kids are smart and will draw their own conclusions.
