    Hi, I had a hypothetical question about child support. I am from Toronto On. Lets say a woman or several I slept with got pregnant and had a child but didn't inform me until many years later. For Example 7-8. Would the court order me to pay all of the child support that wasn't paid over the years since the other party wasn't informed? I understand that child support is due every month but there cannot be a circumstance where there would be a cumulative amount of child support due over many years to be paid at once would there?

    My STBX refused to pay CS until I motioned for it as well as arrears. I never got the arrears.

      The clock starts ticking on when she advised you. If she told you yesterday you were the father and then motioned for 8 years of cs, you could argue it causes financial hardship and undue enrichment. If she told you five years ago and you are continuing to refuse then she may be able to successfully argue for three to five years of cs.

        It's my understanding that the standard procedure is to start arrears at the point of request. If some random woman claims her child is yours and you owe child support, it would start counting on the date she informed you and requested the CS. If you didn't pay up at her request, and she had to take you to court to get it ordered, the judge would order arrears going back to that original request date.

        If you believe random women are going to start demanding CS from you, I'd recommend paternity tests before you start paying anything. So that could cause a delay that would create the accumulation of arrears, more so if you refuse and she has to take you to court.

        If this is a real possibility to you, I'd start setting money aside, just in case. Sounds like you had some youthful irresponsibility that's coming back to bite.

        Your real danger is if there are women out there who have been suggesting all along that their child is yours, but you have been brushing them off. If they are now reaching the point where they are taking you to court, and can prove both your paternity and that they have been talking to you about CS for years, then you're in trouble. Time to face the consequences.

          Thanks for the responses! So what your saying is I would only be in trouble if I was refusing child support the whole time but if someone contacted me years later and I agreed to pay the child support the courts would just make me pay from that point on?

            Thanks for this thread, guys. I have proof of requesting CS about 5 months before it was started. I'm going to try and get an order.
