  • interim child support consent

during a court proceeding with a current interim child support order, does the consent document need to be signed and witnessed by support payer first and then sent to the support reciepent ? Or can it be sent unsigned to the other party and asked to sign and return same if agreeable to be signed and put into an order at the next court date? The issue is that my witness won't be able to sign until the next court date - the lawyer that is seeking to come off the record - but the lawyer has agreed to put this in place before coming off record

I have done a consent order twice and both with and without lawyers.

If no lawyer I had to get a person who was a commissioner of oath with a witness and have us both sign off on the order in front of them. That was accepted by the judge.

Second time, my lawyer wrote up the order, signed it and then sent it my ex lawyer to have it signed by the lawyer. So neither of us signed it.

Both instances it was accepted by the court and stamped.
