    In Ontario do section 7 expenses take into consideration the total household income or only the income of the biological parents.
    My ex earns aprox 60% more than I do and her partner earns the same as her so their total household income far exceeds mine, yet I am paying 40% of the section 7 expenses (primairly due to nanny).
    Her total household income is much more than mine and her partner is very involved in our children's lives.
    This doesn't seem right.

    It is the duty of you and your ex spouse to support your child. It is not the responsibility of her new partner. It sucks but that's how it works.

    You can dispute the expenses being reasonable and necessary, or you can plead undue hardship in court if you meet the threshold.

      No it doesnt include their income BUT the expenses should go through a "reasonable" type of test. That includes what you and your ex would have been able to afford if you didnt get divorced. If she is registering them in every activity and event available because she and her new partner can afford it but together the two of you wouldnt be able to afford it, thats unreasonable.

      Youre allowed to say no. You dont have to agree to everything.

      If its a nanny though, that might be a tough one. Daycare is expected to be covered so the other parent can work but if its double or triple what another available reasonable daycare in the area could provide there might be a question. How you go about fighting that is difficult though.
