  • Offers to settel

My Ex wife and I separated many years ago and haven't settled anything. She just hired a new lawyer. Her old lawyer wants 1500 dollars for her file. She has asked me to supply her with her last offer and my last offer since she doesn't have copies. These offers were done back in 2007. Hers is still valid since it has no expiry date. Basically it's can be withdrawn by her on once we go to trial. Which we haven't done. My question is should I give her these offers. I asked her why she needs them and she won't tell me.

her old lawyer wont release her file till the bill is paid. She probably just wants her new lawyer to review the offers but doesn't want to pay her last lawyer to get her copies of them.

I don't see what the problem is with providing your offer. You could update it and see if you can finally get things finished. If you didn't like her offer, I wouldn't bother digging it up. Just tell her you didn't accept it, but she is welcome to suggest a new one, or give you her rebuttal to yours.

My ex changed lawyers a few times and didn't have his act together insofar as having copies of previous Orders. He's pretty lazy. I didn't see any rationale to not providing them to him. In fact at our JDR (divorce hearing) I provided any documents he required, right in front of the judge. My lawyer rolled in a big cart at the start of the day and we indicated that we would be pleased to provide any documents the other side might require. Judge seemed impressed with this. I certainly had nothing to hide.
