  • "The "child's best interest" is NOT a court priority!

    A number of posters on this forum have written that the court's number 1 priority is the " best interests of the children.

    I beg to differ. My experience has shown me that this is not at all the case. I firmly believe the judges and lawyers use the phrase "the best I interests of the children " to justify their actions, give themselves a pat on the back and soothe any feelings of misgivings or guilt they may have. This phrase is especially useful when a father murders his ex and their children or when a mother is driven to kill her children. It's also a wonderful phrase for a judge to
    fall back on when a father is driven t commit suicide. After all the judge was only acting in "the best interests of the children".

    The only thing that gives me comfort is knowing that one day those same judges will themselves be judged by a higher power. They will have to answer to God for all the lives they have destroyed.

    I could not agree with you more. There is a higher court and all of us will have to face the final judgment in the end. Call it the law of Karma or God or whatever else you want.

    Don't put your faith in the court system, you will end up jaded and disappointed, we are merely file numbers in a corrupt system. Our children are little money bags - it's all a game.

      The best interests of the children can mean anything to anybody - it can justify sole custody, shared custody etc.... the point of the phrase is that ambinguity costs money to resolve and the resolves are the legal system. I think more than 1/3 of cases in civil court or family matters.... that means 1/3 of all judges, lawyers etc... are there just to deal with "the best interestes of the children". The rest of divorce is pretty straightforward.....

      One thing I learnt, is that non-profits exist to self-perpetuate themselves because the people who work there are self-interested in keeping their jobs. It applies to any non-profit business including government agencies.

        One of the biggest problems is that judges are not held accountable in any way for their decisions. If an ex spouse murders his/ her children because the judge gives them unsupervised access... Oh well... Next!

        In a hospital were an physician's incompetence causes the untimely death of one or more patients, there is a checks and balance system in place to address this. They can be sued, suspended and fired. No such consequences for judges!

          I had this discussion with my lawyer once and her response was ,
          " everyone in the court knows they are the judge involved with the murder/suicide and they don't want that. Its not good for their reputation and they feel bad. Who wants that?".

                The courts are getting better. I mean two decades ago, it was tender years doctrine where mom got kid no matter what, then a decade ago, it was the primary care give, now it's the best interest of the child.

                So imagine the hell the poor kids went through during the tender years court cases being given to a person based upon their gender and not their ability to take care of a child.

                And for me, so far, I have had better luck with judges than my own lawyers in agreeing what is in the best interest of the child.

                So there is whole other spectrum of sh*tty lawyers in the mix of good ones. It's like that with any profession.

                Yeah the accountability thing is lacking but what do you propose? A tribunal of top judges when there is bad ruling, he gets penalized?

                What circumstances would need to occur to say this is an appeal versus judge needs hand slapped?

                So if he makes a ruling and somebody dies because of it, he should be what? Jailed? So now he's also held liable? and what is this punishment?

                  If somebody dies because of a judge's order they should be held accountable in a similar manner as other professionals.

                  Some suggestions would be a public inquiry and review of their decision making process regarding that case.

                  Immideate suspension while an investigation is undertaken.

                  That the surviving family members can launch a wrongful death civil lawsuit against the judge personally ( similar to a medical doctor).

                  If upon investigation the judge is found to have erred, this must be remedied by such things as termination of their employment as a judge, supervision by another judge, further education for the judge in the identified areas that led to their faulty decision making....

                  These are but a few suggestions.

                      Right, and who will be judging these faulty judges? other judges - like they don't watch over and cover up for their own? Same waste of time as trying to reprimand a bad lawyer, it takes years of money and patience and rarely leads to any semblance of justice.

                      Sorry, but the legal system is so well entrenched and corrupt, that it would take nothing less than a complete overhaul to fix this abundance of serious problems.
