What is considered an impartial opinion to a judge?
My daughter is in with a counsellor. This was a counsellor we both agreed to but I chose the centre (as per the court order) She is an aboriginal youth worker. She is also overseen by a team from the aboriginal healing lodge which includes a child psychologist who oversee's all her recommendations and reviews the case notes and all the court documents, school records ect.
This counsellor works out of a community agency in our neighbourhood. She runs an aboriginal family program on Wed nights where she does interact with myself and my children (although limited with me and the older and youngest as we do get separated into different rooms.) She also is the counsellor for my younger daughter. My step son also see's a counsellor through the agency but with a different counsellor. I am Metis as is my daughter. We are part of an aboriginal community. As part of the aboriginal work there is often some crossover of interaction as the community is smallish, and part of our way of life is community based so the counsellor does have some interaction with us. She has however made time to meet with mom alone, she isn't being paid by me.
My ex just sent me a huge email saying that she will not negotiate based on the counsellors recommendations as she is going to contest that they are not an impartial counsellor. She also wants a new counsellor involved and said she would verbally contest all of this on monday. (not sure why she emailed me as I didn't make any new offers to settle with her)
Will the judge see this counsellor as impartial?
