I just got back a response to a Request to Admit. More of my facts are accepted as true than I expected, which is nice.
The other party also says that since some of the facts occurred before existing Orders, those facts have 'already been litigated,' with the implication that they are now out-of-bounds.
This is problematic because the facts are relevant to current issues. There have been several consent Orders since some of the events in question occurred. Does this mean the court will refuse to hear about these events?
