    Hello All. Newbie here.


    Last week I was in court (self-rep) to give my ex-partner a divorce. Her lawyer sought the following:
    10) "The Divorce be severed from the balance of the corollary relief and all claims for corollary relief and additional relief in the Application and Answer, not already resolved by way of Court Order or Agreement, to continue as a corollary relief proceeding;"
    11) The divorce is to proceed on an uncontested basis


    I agreed to give her an uncontested divorce asked for here and said this:


    9) The Divorce be severed from the balance of the corollary relief and all claims for corollary relief and additional relief in the Application and Answer, not already resolved by way of Court Order or Agreement, to continue as a corollary relief proceeding;"
    10) The divorce is to proceed on an uncontested basis;
    11) Enforcement and Adherence to dates and obligations outlined in the Consent to Temporary Order as outlined in the document.


    The dates and obligations identified dealt with the division of family assets. I am wondering if anyone could comment on the process to get the other party to the courtroom again to finalize the division of assets. My motion contained dates however the judge's order said "in due course" and I'm afraid that may mean whenever she gets around to it. She has all the money in the relationship as I paid all the bills and she socked it away. It worked OK until I was exposed for the sucker I guess I am. 2 young kids...heartbreaking.


    any help would be appreciated. Everyone wants to move on.

    Its not a question of when but what. The more issues, the more time it will take.

    I could ask why court? I had a combative ex, but we avoided court, because it would cost more than it was worth.

    Are either of you disputing the general principles in the divorce act? If you paid the bills and she saved the money, then you should not be penalized, you should get half of the savings (unless part of what she saved was pre-marriage or inheritence, and she kept them separate), and she should get half the bills.

    Divorce can be hard on kids but they survive. They survive better if they know they have two parents who love them, and that they have access to both of them.

    What was the point of getting a divorce before the issues were settled? Is someone remarrying?

      No, it's been 15 months of me trying to convince her to not go through with it. She's not confident to do it without a lawyer.

      The only things to settle are the division of assets. We basically agree on the assets - minor valuation differences.

      I'm really just interested in not having this dragged out for a long time. We both deserve to put this action behind us if the divorce has been granted.
