    Hi there,

My ex is using legal aid. Can she ask for costs?

    Have a nice weekend!

Yes. In fact, it is expected of the panel lawyer representing the party who has obtained a Legal Aid Certificate to do so.

    Legal Aid Services Act, 1998, S.O. 1998, c. 26

PART IV - RECOVERY OF COSTS FOR LEGAL AID SERVICES:

    Legal Aid Services Act, 1998, S.O. 1998, c. 26

    Good Luck!

      Hi BitHunter

I asked my LA lawyer the same thing when he (my own lawyer) asked for costs. He said absolutely he asks, no different than any other lawyer.

I wonder if a judge would be more likely to award costs to a legal aid client/lawyer if they win their case, as it was paid by the government? Wonder if they would see it as a "waste" of tax payers' money and therefore would a judge be more likely to try to recover it? Just speculating. I don't know for sure.
