  • Sale of property

So tell me what's wrong with this. Judge ordered sale of property. We were to agree on company to acess the value due to it's size. So I provided 2 companies to choose from(no response) until after the 30 day peroid. Now her lawyer say's no past 30 day peroid too bad. Her lawyer said property is being sold by realtor chosen by her and her family. Now her family uses this realtor to sell homes for them. I do not feel this right. He judge says realtor has to be agreed on but that's not stopping her. Can you say run away train and my lawyer has done_____.

Did you have the house appraised before this?

I don't understand the point of getting an assessment/appraisal, if it is to be sold. The house is worth what it sells for - the market price.

And perhaps, if this is an agent used often/in the past by her family, you are getting a deal on the commission -- I'd ask. If you are on title, you have to sign the listing agreement with the agent, by the way, so if you don't agree - don't sign. Bring an agent of your own choice in quickly to give you a realistic market value. If her agent is in the same ballpark, AND will give a cut on commission, couldn't this be win-win?

He seemed to be upset about it being a real estate agent that is close to his ex and her family. If he already has an idea of how much the house is worth then it may ease his mind that he isnt getting screwed.

I can get an appraisal saying my house is worth $$$$.
However, on the current market, it sells for $$.
It is, therefore, worth $$. Not $$$$.

My point is that it gives him a starting point of what the house may be worth. Better to have an idea of what comparables are selling for (like my certified appraiser did) then to have unreal expectations.
