Can I file my own form with the FRO, or must I have a lawyer?

I beleive you need a seperation agreement or a court order. Check out the FRO web site. Hope this helps.

I have been pouring through that site most of the afternoon... thank you.

However, it would seem to me that a person should be able to go through the FRO without a separation agreement... it seems to me that the FRO is absolutely FOR parents whose partner are not acting reasonably through a separation/divorce.

I am going to keep reading... hopefully I can tackle some of this myself. I just hate giving lawyers (no offense Jeff) a single dime more than I have to! ...and I even have lawyers in my family! hahaha!

I still think that you would need some kind of seperation agreement or court order to prove to the FRO the amount of support. Do you have anything in writing?

          beltane,

I went back to the site and got this quote. I'm sure you either need a court order or seperation agreement. Do you have one?

"Please note that FRO only enforces those provisions of an order or agreement dealing with child and/or spousal support"

          Hope this helped.

            Beltane,

I believe you have to file your separation agreeement with the court and the court (registar) would issue a SDO (support deduction order) to the FRO before they could be involved in your case and enforce support orders.

              beltane,

FRO is simply an enforcement agency. FRO just enforces an existing separation agreement or court order. It sounds like you don't have one in your case. FRO doesn't have the power to decide how much support should be paid - only a judge does.

If a judge orders support, the court will automatically forward the appropriate documents to FRO (if you haven't filed them, the court will normally contact you and ask you to file them; also many courts won't allow a motion for support to be filed without these forms).
