  • Question: Did SS increase.

    I was doing some calculations on "my divorce calculations" website and have noticed that the SS has increased. Are u kidding me!? My calculations for my support rose approx. $300/month. How is this possible? I can barely make ends meet now.

    Did you not notice a different amount until you opened the website? Do you not check your bank account regularly? I would certainly notice a 300.00/month difference either way.

    I don't understand how this would be a surprise to you.

      If your SS is adjusted yearly then yes it can go up/down depending on the ratio between your income and your former partners income and any changes in child support or family related expenses you still pay.

      Personally, I made sure my agreement stated that SS would never increase once set because my hard work and success post-separation is not for her benefit as we are no longer together.

        Remember the SS Guidelines are true "guidelines" and mydivorcecalculator.ca is not an authoritative source on what it should be.

        SS often requires, as stated by Justice Quinn in Bruni v. Bruni:

        9. Spousal support

        [158] I come now to the issue of spousal support, historically the roulette of family law (blindfolds, darts and Ouija boards being optional).
        It is often hard to determine what optional roulette wheel, blindfolds, darts and Ouija boards are used by mysupportcalculator.ca to come to their numbers are. Generally they are close, just like DivorceMate.com provides but, the complexities of SS are vast and require evaluation by the court as the SSAG is a true "guideline" and not contained in an Act or other legislation.

          in addition to above, depending on the length of your relationship, you can go back to court to argue that SS should decrease since last calculation because EX has not seeked to get of SS i.e. become self sufficient etc.

            Thx for the replies. I make the deposits to her account. I was just wondering b/c I fiddle with that website and just noticed the mid point went up all of a sudden. I was also told that is not the actual guidelines but rather a close estimate however everyone's situation is different. It's in my agreement that our incomes are to be revisited yearly.
