    Criminal Trial today re: breach of court order. Court Order refers to a 810 Peace Bond I signed from when my ex accused me of threatening her.

    Signed a Peace Bond, and figured that would be the end of it. Four weeks afterwards, get a call from the cops saying she claims I called her contrary to the conditions outlined in the bond. Her new husband is apparently a 'witness' to the fabricated event.

    Not taking another 'deal' this time - as it's more than apparent she will somehow turn it against me again if I do.

    I could officially be a convict in less than 4 hours....

    Hopefully the truth prevails.

      Hopefully things work out for the best. Unless they have phone records of you actually calling their numbers the third party witness is again, hearsay and under the rules of "beyond reasonable doubt" in a criminal proceedings it can be argued that there is reason to doubt the allegations of the husband. Unless there is hard solid evidence (phone records) they are proceeding with hearsay.

      There is good reason for the witness to lie... Child support, and all the financial gain that could be reaped from the results that the results of this proceeding could be in a matrimonial dispute. You have contested child custody and access before the court.

        Good luck!

        I would think that unless they have phone record confirming call from your phone and/or recording that it actually you who called I do not see how they can pull it off.

        On other hand would be interested base on what police actually laid charges. It not like family court with all thous affidavits I would hope

            There doesn’t seem to be any consequences for liars really,if the judge notices the lies it will work in your favour but lying on affidavits is perfectly normal for some people.I thought it was like the movies and of course I was 100% honest but my ex lied and lied. Then forgot his lies and then got people to vouch for him, but lied to them too so what they had written made no sense at all!It was awful because this is my kids who will suffer if the judge doesn’t use logic and common sense ,but it was also rather funny!There was lies about things that no reasonable person would lie about.Stuff so trivial you would not believe it.

              ML: ohhhh, I'd believe it... our ex's must be long lost identical twins. Same happened w/me. Total circus of lies throughout court and Trial. He made a fool of himself. It was actually quite funny. I wish I had it on DVD. Hopefully Wretchedois will come back with some good news to report.

                    Charges were withdrawn by the Crown about 10 seconds before trial was to begin.

                    An hour before that, the Crown was offering me a conditional discharge.

                    It pays to stand up for yourself.

                      so you turned down the offer and decided to let it ride? Sounds like things went your way. Wonder what a conditional discharge would have entailed.

                          Conditional Discharge is either a guilty plea or finding of guilt. However, the court does not 'convict' you.

                          Consequently you are placed on probation for a period of time not to exceed three years.

                          Your plea, or finding of guilt, would be sealed and removed from cpic after successful completion of probation.

                          Thus, you would be spared a criminal record.

                          It helped that in her statement she specifically said that I called from my home line (she said she saw caller id and answered anyway in her statement). I brought my itemized Long Distance (as its a long distance call) phone bill and showed it to the Crown is discussions.

                          It was pretty clear no such phone calls were made from my home line.

                          Or at least thats my take on it - don't really know what the Crown thought.

                            IT's bad enough to go through separation/divorce but to have to go through the ordeal of criminal court on top of everything isn't good.

                            Congrats on a good outcome. Watch your back - the ex sounds like a psycho.

                              It's actually more my ex's husband than her.

                              And yes, I suspect this will not be the last ime I have to deal with similar shenanigans.

                              In discovery, it came to light that her new husband had called the cops on me 8 times in the 7 weeks previous to me being charged trying to have me arrested/charged for breaching the peace bond.

                              I was looking forward to crossing him, as I was hoping being self-repped the Judge would have given me some lee-way in questioning. The hope being to get him to shoot himself in the foot on record so that come the next dance in Family Court I could perhaps show who he really is when it comes to conflict.
