    Looks like she would certainly have a hard time proving it on motion. According to this case (and others cited in the decision) it is a triable issue. This case has no trial decision, so it likely never got that far.

        This might help hopefully...judge ruled that child had support from bio parent and step-parent didnt have to pay any support.

            Billm, I took this to mean a thank you for the help I was able to provide OINK with an "Offer to Settle" and some other stuff he had sent me a PM about.

            In respect to my own comment, I just assumed given that he is clearly able to do research on Canlii himself, it was a bit "cheeky" to ask others to do so. But hey, if anyone wants to help out OINK with a bit of research here, please help him.
