  • Splitting assets

My ex is trying to devalue the assets left in the martimonial home and say that the items I have are valued at purchase price.

She wants me to sign off on her pension, RRSP and the house which is paid off.

I've asked through her lawyer for a comprehensive listing of all the is in the house and around the house but she keeps coming back with the claim that i've taken more than what is left.

My intension is to get as much as I can in furnishings and such seeing as I'm letting the house go.

Any advice on how to get what I can from this whole mess. I'm not sure how to respond to her lists and really only want closure. But I want to make sure that I don't find myself down the road regretting letting all go.

I walked away with my home theatre, clothes, two couches, some living room tables, my bed and a computer and some smaller stuff.

I left her with all the appliances, all the kitchen stuff, the home theatres, a full gym valued at about $10K and so on and so on.

    And the house.

    Please send advice.

    Thanks

The house is always 50/50. If her pension and RSP increased in value during the course of marriage that too (increase only) will be split 50/50. Regarding the contents of the house, it is always grey area. You cannot value them at the purchase price as only the market value is considered and divided.

I strongly suggest that you speak with a lawyer before you sign off on the house and RSP etc. I am little surprised though that you are willing to give up the house which is fully paid off but are fighting over some used items.

before you sign away any rights to her pension etc give her a list of what you want. You can use the pension and rrsp as bargining chips if you end up having to play hardball.
