  • Seven days jail for Michigan mother who refused to follow court order to vaccinate

    From National Post article:

Seven days in jail for mother who refused to follow a court order to vaccinate her son | National Post

Horne’s attorney, Benton Richardson, was not available for comment Wednesday, but he told ABC last week that the legal dispute was not about vaccinations.

“It is a case about Ms. Bredow refusing to comport with any number of the court’s orders and actively seeking to frustrate Mr. Horne’s joint legal custody rights,” Richardson said.

Consequences for defiance of orders should occur more often. Result would be less defiance.

The mom shows terrible judgment in terms of the child's interests by refusing immunization, and in repeatedly defying consent orders- bad enough behaviour to have her sent to jail.

Nonetheless, instead of the court turning ongoing care of the child over to dad, who is (it seems clear) the more competent parent, the child will be looked after by dad only for the week that mom is in jail. After that the child goes back to the care of, mom, the less competent parent.

This strikes me as a bizarre example of the courts falling all over themselves avoiding having children cared for by their dad when mom is not a competent parent.
