  • CCTB retroactive?

    My ex just asked for a letter dating our separation for this. If he applies for the CCTB, how far back do they go retroactively?

    This could put me on the hook for thousands of dollars! I know...it was supposed to go to him initially, but it's not my fault he didn't apply at the beginning..after I told him, his lawyer told him....

    I did put a stipulation that he would also sign the same letter, agreeing that I paid my CS obligation to him from Aug 2008 to June 2009. I was not able to put that on my taxes last year, since there was no written agreement. That would at least let me ask for a reassessment for 2009. Somehow it all got left out of the court order

    I think it is retroactive for this tax year. What I mean, the CCTB runs from July-July based on the previous tax return, so if you change it now it would be for just the last month or two.

    I remember reading that they won't make a retroactive change going back years but I can't remember where.

    When we filed the change of status, they just went back for that year's payments. I think the change went through in September or so for me, and they just did it back to July, even though we'd separated much earlier in the year.

    I don't want to promise though, you should check with CRA.

      When I went through this last year I was told by more than one CRA employee that the limit was 11 months.

          well shit hit the fan today. got a call from the bank trying to collect on HIS visa (one which my name was not on). Had a meeting with him to discuss CCTB letter and gave him a copy of the financial statement document to fill out. He thinks becasue he claimed bankruptcy that it negates his responsibility for equalization. what a hoot.

          So I guess I am taking my custody order with me to court Monday and filing an application to start the divorce. He is not going to work with me to figure out how to pay of $1300, of which I have already paid my own share.

          I did make sure to put all the shared accounts on hold a long time ago, but he just never bothered paying his share. I know, kick me for not doing it right, again.

          But this time I'm going to bury him. And since we had a confrontation 2 weeks ago, and I called the cops, CAS is involved, and I may have some additional resources available to me. Nevermind the fact that he did not follow the OCL recommendation and has moved FARTHER away from our daughter's school, while I have moved to within 7 kms.

          ARGGHHHHHH!!!

              When I applied for it, and was granted it for 50/50 - it was not retro-active.

              When my ex and I settled she would have full custody, she did not file the paper work and I continued to receive the benefit for a bit.

              Now that its going back to her full time, it is retro active and I have to pay it back.

              So I guess the answer is that it may or may not be retro-active.

              Go figure.

                Do you have 50-50 and did you file for it yourself? If she was the only one that filed for it then of course they'd only send it to her.

                    turns out is was..and ruining my credit. Had to go further into my own debt and pay it off myself. Will be asking for that back in equalization though
