  • Joint debt HELP!

    Before we were married my wife had a line of credit. After marriage I had a credit card with my name attached to that line of credit. Now we are separated and although I would like to just take my half of the debt we built up while married and move on, the bank won't give me a loan unless I get somebody to co-sign. I do not have anybody who will do this for me. My question is how do I pay back my half? And if the line of credit is in my wife's name (I no longer have a credit card attached to it) how could she ensure that I do pay it back? I don't want to leave her with all of the debt, but my financial situation is dire and at the very least I'm sure there will be months that I can't pay. Can I just pay her back directly? Is there any legal way for her to get the money from me?

    I should also mention that we are sharing custody of our daughter 50/50. I pay for half of everything as far as my daughter goes, food, clothes, etc. We do not have an agreement for child support or spousal support and we have been separated for 3 months. I moved out and live nearby. My ex will be a full time student as of next week, but I think she will still be making more money than me (sad, I know).

    Just looking for advice on how I should proceed.

    The debt will get divided up as part of the equalization process. You don't need to address it right away on an individual basis. Perhaps you'll end up giving her a greater share of the assets to make up for her taking on the whole debt.

        Division of family property.

        Search it in the forum and set aside around 5 hours to get your head half way wrapped around it.

          Thanks! Though 5 hours of this and I might just decide to give up all my rights and money and just go live on a beach somewhere...

            Sorry couldn't help it. If you are ready to toss in the towel after only 5 hours...dude you are COOKED if things turn ugly.

            I've spent 1000's of hours over the last two years on my own divorce, and I'm pretty sure I'm one of the LOWER end of the scale people.

              Would you like us spend the time for you? My rate is $125/hour and I take VISA, M/C and AMEX.

                That's cheap. My lawyer charged me $400/hr.

                My company whores me out for somewhere between $250/500 hour on contracts. Not that *I* see any of that love, but w/e
