It is a limited company in both our names. We had a business befor that we sold the assets. We used the money from that sale to buy property. We kept the limited company name and I purchased the new store with money from my mothers inheritance. She worked as a normal employee on the payrole. I was not on the payrole.

    Hope this helps

You say that she and you own the company but later say you purchased it with an inheritence.

Can you clear up that area for us. Is the legal company name registered under both her and your names? Did she just work in the store as a normal type of paid employee?

The simple answer to that question is NO.

Even if you were legally married, the reasons for the breakdown of the relationship, including past bad behaviours, have no bearings in court.

This is especially true when determining the division of financial assets.

    Commonlaw Joint Company

My Common Law wife and I own a company. I purchased a store that is listed under the legal company name with money from an Inheritance. The business is not making money yet its actually costing me monthly. My ex that recently threatened me with a knife and assaulted my is trying to get money from the separation regarding the store. She did work in the store and was paid regular payrole monthly. I was not paid but took a draw occasionally.

Does she have any right to the business after separating.

Does the fact that she had a knife at me and was taken away by the police and given a no contact order benifit me in anyway regarding the separation??

    Thanks
