Child Support paid to the Child if "away" at College???

  • Child Support paid to the Child if "away" at College???

    Ok, so I am working on my "requests" for a varied CS order....

    I understand that it is possible that the NCP could pay CS after the age of majority IF the child is attending college/university on a full time basis... and I understand that the CS would be paid to the CP for "maintaining the home".

    My question is this...

    I think the $$$ could be put to better use if it was sent directly to the Child, IF the child is "away" at school, (living in residence).

    How would I word it in the Order that, if these circumstances arise, that the CS payment can be paid directly to the Child???

    If anyone has something like this in their order, could you please tell me how they worded it?

        Has anyone out there directed their CS payments to their adult children, instead of the CP after said child reached the age of majority?

        If so, how was that worded in your court order?

          We did, but child moved out of CP's home and was attending school in another province, she had her own agreement done up and we pay directly to her. This was in Quebec, so???

            As long as the CP is looking out for the needs of the child I would suggest to you that the legal costs you will incur trying to change this with a non cooperative CP would not be worth the fight. Remember that the CP usually is the one still paying for the primary expenses of the child such as food, clothing etc. and many cases still maintains a room at home for them as well when they return for holidays, weekends etc. Putting this money in the hands of your student may just encourage them to misuse it for non essentials which the CP will then have to provide. You don't have much longer to go till your child is independent. Why rock the boat and give your money to lawyers instead of the CP who probably has justifiable need of it. Your lawyer will be happy to encourage you to do this but it is unlikely that you will win if the CP is not in agreement. It will make the lawyer happy though. As well your child may think you are just trying to hurt the CP, so ask yourself - are you? If so, then think twice before lining hungry lawyers pockets.

              Your reasoning makes total sense to me. Why pay CS if the child or children are now NOT residing with the custodial parent and hence the custodial parent is no longer responsible for day to day expenses of the children. I see no reason why you cannot pay for part of their education DIRECTLY to them bypassing the custodial parent. Makes total sense to me.

                I am sorry that I didn't clarify my situation. I am the CP and I am preparing to return to court on a Motion to vary. I am anticipating that my child will continue on to college after highschool.

                My original court order doesn't say anything about CS after the child is 18 and still in school.

                I have seen on this forum that paying CS to a NCP when the child is away in college, is a VERY contentious issue with the CS payor.

                In an effort to be as reasonable as possible, I thought it might be a good idea to offer to direct the CS payments directly to the child if this situation occurs???

                My child is quite responsible, and I don't think that she would be irresponsible with the money... I hope she wouldn't

                I just thought that IF she was over 18, living in college residence, and the NCP was forced to continue to pay CS, that he might be more comfortable with it if the child got the money, instead of giving it to me????
