    Hi, I’ll try to explain as clearly as I can with made up numbers

    I file 2021 taxes but the amount of support payable was understated resulting in their computer limiting the amount I could deduct. Instead of them owing me 5k they thought I owed 5k. It took almost a year to fix but now they recognize they owe me 5k.

    ex filed her taxes incorrectly and understated how much ss she received.

    Now that cra has reassessed me and determined my ss was actually higher, does it automatically trigger a review of hers? Bc if their computer updates the amount of ss for her, she will get a lovely bill.

    5k as an example above is really lowballing
    she already owes them 50k, and I’d love her number to be higher so maybe she will actually negotiate

    again…she refuses to

      Yea
      her lawyer broke the rules and served a 200 page supplemental affidavit, lied to the judge by saying we never had a case conference
      the judge got confused thought this was an emergency motion and booked a case conference, I turned my mic on and said we had a case conference…then the judge flipped at her lawyer..and booked a settlement confernce
      then ordered her to pay the cost award within 30 days (5 minutes later he agreed to release money from the trust) which is exactly what we offered

      it for adjouned to 28th and again we said, provide disclosure and where the mystery money came from and we will mediate


      the mystery money came from her parents company for sure and it’s cash income..so this makes a huge deal
      as much as people want to say “well what is she going to do now and they’ll have sympathy” I don’t think that sentiment holds true for liars and people who act in bad faith..but I digress, I asked to mediate, she said no

        I just went through this with the CRA and I really dug.
        The answer was effectively "I don't know" from 2 people that the call was escalated to.
        To help things along report it via their tax fraud process.

        It is absolutely stupid that they do not have this locked down.


        Question: Why is it important to you that your ex report the SS correctly to the CRA.

          Hi,

          She understated what she got in SS. The reason was that my income dropped massively, I went into arrears and she had money taking from my half of the house to cover the arrears.
          She forgot to include that amount divided for 2020 and 2021. It was not fraud just not paying attention.

          Why do I care? because it is to the point where she has to be cornered financially with collections coming after her where she will have no choice but to settle. I really am dealing with someone who will not negotiate

            Been there myself. It seems the CRA system is locked when it comes to UCB (child tax benefits or whatever it is called these days) - if both parents claim having child living with them (no as partially) it would trigger audit for both (did for me, and I won the audit), but I don’t see similar actions for the support. Seems CRA doesn’t really care that two people report different amounts, and their suggestion to tip the CRA fraud line is very inefficient. I didn’t go personally that route, but friend of my did, and three years after the tip nothing was done.

            well, maybe something was done, but CRA doesn’t report if it was, and the ex claims not having reassessed NOA.
