    so....


    I was involved in a motor vehicle accident (I was a pedestrian struck by a truck) in 2004.... I started dating a girl in 2006. We hit it off quickly and got married later that year. We are now seperated and have been for 2 months now. My settlement is actually coming into year 5 because of the seriousness and extent of injury. My question is she really legally entitled to my injury money? Would it be wise to post pone my litigation until the divorce has been finalized? help. I don't feel legally obligated to give her anything as this injury does not pertain to her,nor does suffering,income loss and permanent damage.

    There are no children involved and no real big assets. Everything in the house I told her she could have,so it would be somewhat amicable.

          If you are married, everything you own together or in separate names is divided (usually equally) between the two of you, subject to specific exemptions:
          Property acquired prior to the marriage by one of you;
          • An inheritance
          • A gift from a third part to only one of you;
          • Proceeds from a personal injury claim or insurance settlement.





          That is what I found out,but i'm going to seek out a lawyers second opinion just to be safe...
