I am more of a lurker here and learn from all the valuable information that all of you share.
I had started a motion to change this year. Needless to say financial disclosure is being delayed . So finally our settlement conf judge told me to file a motion.
Financial disclosure is regarding his self employment and another business that he had not disclosed. I asked all the financial statements bank records etc. . Everything that I have read here that is required by law for him to produce.
I filed the motion and the date was early September. Ex has a big shot lawyer. He wanted adjournment which I agreed. Motion date is on Thursday. Lawyer serves me documents today but missing the affidavit. Today is the last day to serve me by process server. He served most documents but no affidavit.
I contact the lawyer for the missing affidavit and he says thanks for accepting the documents and that he will give me the affidavit tomorrow????
How can he do that when his deadline is today? What should I do ? I'm sure he will file the whole documents and the affidavit and show today's date on the 6b service document.
I'm upset because I have no idea what he is gonna say on affidavit. I had actually revealed in my affidavit the business that he has been hiding for almost 10 years. Obviously he has to respond to that.
I don't want his lawyer to knowingly not serve on time. What can I do in this situation? Should I write an email to him and disallow service and ask the judge to not allow it ( even though i suspect he will still be able to file the affidavit lying that he had served it to me today with other documents)?
Also the reason I understand for the serving deadline is 7 days for me, and 4 days prior to motion date for him. And then I still get 2 days to serve a response. If he send me the papers tomorrow when will I get the time to report and file if I need to? Isn't this why there are deadlines for serving documents???
