  • STBX's offer to by my half of Marital Home - Question

    Hi community,

    Ok, so I have an email from STBX's lawyer with an offer to purchase my half. It contains price, closing date, and several, but not all details of transaction.

    I subsequently prepared an agreement with help of real estate agent and then sent to STBX's lawyer.

    I have not heard a thing since. We turned down the only other offer in hand because of STBX's offer and now we are nearing the end of real estate season.

    I have asked for an update from STBX lawyer, and nothing. We have a settlement conference on Sept 18th.

    What aggrivates things is that the vacancy rider on the home's insurance policy cannot be renewed past end of this calendar year. So unless someone moves back into it before then (its vacant - we are all in toronto) we are screwed for insurance.

    So here are some of my questions.

    1. Am I correct in thinking that the emailed offer to purchase the property from STBX lawyer is binding ?
    2. In light of the fact that we turned away other offers, any resulting damages incurred by me based on her not following through on this purchase are grounds for uneven division of assets ?
    3. Do I start harrassing STBX lawyer to get moving on this deal ? (I really, really don't want to have to do this if I can avoid it.)

    I can't answer your questions, however a suggestion regarding insurance: get a short term renter I'm until the house closes and take out the appropriate insurance. Make it clear to the ex that she will be expected to contribute to the extra cost as it is her actions that have incurred the costs.

      I would speak to real estate agent about #1, offers are in fact binding but the recourse is probably one for damages. Which is related to #2 - I am not sure it would be an unequal partition rather it might be a civil damages claim....

      I have no citations and I am not a lawyer but just giving you my 2c
