  • Moving in with my girlfriend, common law?

    Hey everyone,

    My girlfriend wants us to move in together, but I'm trying to wrap my head around how common-law status would impact my finances, and I have a few concerns. She’s carrying a lot of debt (mostly a big OSAP loan and some credit card debt) and earns close to minimum wage. I, on the other hand, make a decent income, have a maxed out TFSA, an RRSP with about $25k, and an unregistered trading account with a few thousand dollars. It’s not a huge fortune, but I’ve been working hard to save around $2k a month and have no debt.

    My main questions are: if we move in together and things don’t work out a year later, would she be entitled to any of my assets? Also, if she ever struggles to pay her loans, could her creditors come after my assets or income? I tried searching for answers online, but I’m finding conflicting info.

    Has anyone been through something similar? I'm thinking about reaching out to Zukerman Law for advice since they seem knowledgeable in family law. I just want to understand how to protect what I’ve saved up, while also doing the right thing in the relationship. Any insights or experiences would be much appreciated!​

    There is a sticky thread at the top of this section of the forum that outlines some common law information. It also depends on the province you are in. From what I understand, Ontario does not allow any splitting of assets in a common law relationship. It may be different elsewhere.

    Seeing a lawyer who specializes in these issues is never a bad idea and it may help you understand your rights.
