    My common law husband and father of my daughter has recently started an affair - and has bascially moved out to live with her. yet he still feels he can come and go into what used to be OUR house whenever he wants,

    He has given me 3 weeks to vacate the house - even though my name is on the mortgage as well. Since i stood my ground and did not move out when he wanted me too..he is now telling me that he has the place rented out and the new people are moving in i have no choice but to move out now. Can he do this to me or is he just trying to bully me?

    He has as much as moved on..he still has clothes here so I cannot legally change the locks on the house.

    what are my rights? I have no idea im so new to this and cannot afford much of a lawyer


    can some one PLEASE PLEASE give me some guidance so I can stay strong and not let him bully me.

    You should be given time to settle things before anyone has to move.

      As you say you are named on the mortgage, he cannot force you out. As well you both have your child to consider. She needs to be provided for as well. The house would be part of that.
      Sounds like he is trying to bully you.... right out of the house. At some point it will have to get to the lawyers and or court. But does not have to be now. As Billm said you need time to sort things out too. The courts will divide everything up pretty much 50/50. So having said that It will then be up to one or the other of you to buy out the other. As well since you are still named he cannot legally rent out the place without your consent. as well niether of you has a legal right to devalue or hide any assets (wreck the house until it is transferdto the other.
      Like anyone else here will tell you document everything you can even make a journal. Ask lots of questions there are lots who can help.

        i think he is just trying to get you to move out so he and gf can move in.

          It's time to get a lawyer and file for an interim order which allows you to reside in the house and sets limits on his access. He cannot rent out the house or evict you but I can see your situation escalating.

            No renters are going to move in with you standing there saying it is your house. Not to mention the police would put a stop to it too. You don't need a lawyer to stop that.
