  • Have Draft Sep Agreement - question

    I got lawyer to draft up a Separation Agreement; reviewed it with CL partner who wanted some changes to "background' details which we both agreed on.

    I have all the legal jargon and items that need to be covered.

    Do I need to have this redone by lawyer or can I have this retyped and then we get our own witnesses?

    Does not matter who types up the agreement but I would definitely have independent lawyers for both parties and have it filed in the court. My own experience is that non-lawyer signed agreements don't hold much grounds in the court as either party can say that they didn't understand what they were signing.

      I agree... at the very least, have it notarized (witnessed by a lawyer). That way, there won't be many "Well, I didn't know...." later on down the road.
