  • Cross Province -- what forms?

    He lives in Quebec, I live in Ontario with custody of the child. He lives close to the border and has a family lawyer who is qualified to work in Ontario and Quebec.

    There has been a major change in circumstances and we need to change our court order WRT child support, benefits, schooling, etc.

    We would like to do this amicably. Which forms do we use? I have the consent to change form from Ontario.

    Which province courts do we use?

    I am assuming it is the province where the child lives?

    This is complicated and I'd suggest consulting a lawyer. You can call the Law Society of Upper Canada and get a free 1 hour consultation.

    My amateur opinion is that you do not want to end up in a situation where there is one court order in Quebec and another in Ontario. You should either follow up in Quebec and change the original order or have it transfered to an Ontario court since the child now resides in Ontario and any enforcement will be done here.
