    today I have telephone message from his lawyer stating I have til friday to reply to her serving me........thought I had 10days

      I served him first with my intentins for sole custody and support order, also for back extraordinary expenses to be covered.......

          So you served your husband with an application, and his lawyer served you with an answer? If that is the case, then yes, you have 10 days to respond to your husband's answer by serving and filing a reply.

            Okay, I'm a bit confused! Here is the breakdown:

            1. Applicant serves respondent with application
            2. Respondent has 30 days to serve and file answer (or 60 days if respondent lives outside Canada and US)
            3. Applicant has 10 days to serve and file a Reply to the respondent's answer.

              i was understanding that I have 10days to file my answer......our court date is less than a week away
              Have you attended at your case conference (first appearance) yet? If so, did a judge order you to file your answer within 10 days?

                    time lines

                    you stated he has 30days to respond to me........well I filed on April 9th and his response was delivered to my home (I havent recieved it yet whereas Im still at work)

                          it apparently at my home right now........it wasnt there this morning nor last night so my assumption is today sometime before 3pm

                            Hmm. Technically, you are entitled to 10 days to reply. However, it's possible that the lawyer is notifying that you must file by Friday in order for your Reply to get before the judge for your appearance next week.

                            What's the date of your case conference?

                              In all honesty why should I rush through it when I have given him more than the required 30 days...his lawyer took 32 days to be exact
