  • Any one been in this situation?

    I either move to another town in a week or lose my job. Anyone know how they'd approach that in regards to custody and access? The town is 2 hours away. My daughter will start JK in the fall. Right now we split the time 50/50 and he won't consent to just weekends. Am I just SOL and out of a job?

    Another question, the custody agreement says neither of us can move more then 60km away. So what if I move to just inside that? It's not practical to drive her to school 1 hour away so once again someone would have to have her during the week. How would we approach that since I didn't go against that agreement but 50/50 weekly still wouldn't work?

    No one can stop you moving. What your ex can do is stop you moving the child farther than 60km.

    Your choice is to a) move for the job and leave the child with the ex full time; b) move just under 60km to reduce your travel time taking the child to school; c) find someone (*for example another parent at the school) who would be able to provide an hour of care before and after school allowing you to commute; d) seek a motion to allow you to move and take the child with you to the new town and let the ex worry about transport on their time.

    Out of all of these, d) is the hardest and you may not get a court date in time for September. If the child begins school in September and then you go to court, on top of any other arguments you would uprooting them from school.
