  • Child 19 years old not in school, how to cease child support

    My youngest son is 19 and moved back into his mothers house. He is currently working full time and not in school. I wish to file with the courts to cease child support, the mother will not consent, I need a court order!
    1) What forms do I fill out to get this moving forward?

    I just wonder does mother should consent? I mean kid is 19. He can have his own kids now...

      Unfortuneatly, there is a court order indicating I pay a certain amount of cjild support and no indications on when to stop. I need to get a court order to stop, based on my son's "terminating status" as they call it.
      I need to know what form I file to get things going.

        Um stupid question but... at his age can't you just write a letter stating you are stopping for the stated reasons and well stop? I mean he is 19...

          Yes I can do that. The problem is without a court order to stop arrears can incur with FRO. Furthermore, without a court order she can ask for retro active CS years from now. If your children are in school full time post secondary you can pay support till they are 26 to 28 years old.

            You need to file a Form 15:Motion To Change, Form 15A:Change Information Form ... I don't believe you need to file a Financial Statement (but I am NOT a lawyer so please don't just take my word for it)

              Thank you DunnMom, I will get working on the forms tomorrow. I would like to know about the form 13 financial statement. That is a very major form to needlessly fill out.

                If Mom doesn't consent (what a dick!), then you have to bring a motion to change.

                Motions to Change - Ministry of the Attorney General

                Have fun.

                And get going on this (really) sooner than later. You will have one helluva hard time recovering CS that was paid while this glacier moves along. Expect the whole thing to take a few months or more, depending on your learning curve and your resolve to get it done.
