  • Motion to end child support

    I am considering file a motion to end child support and was looking for some feedback. Here is the situation, my 18 year old daughter is moving out of her mothers and moving in with her boyfreind and will be attending university. I have asked my ex to terminate the support order filed with FRO and she refused. I am willing to make gratuitous payments to my daughter. Am I correct that your are not required to pay any support in this situation?

    If she's living with the boyfriend then the mother isn't entitled to child support since she will no longer be supporting the child or maintaining a residence for her.

        Don't think so. She's no longer a child of the marriage.

          I guess it would depend on how the daughter references her bf.

          Does the bf have a job and provide for her as if they were in a relationship? Or do they preceive each other more as roommates?

          If they consider themselves more as roommates (separate rooms) and your daughter is still in school, but has changed her address of residence to her new address, child support may still have to continue. But if her and her b/f moved into a 1 bedroom apartment, he is working and they are living as a couple, c/s would stop as she would be deemed to be emacipated from her mother.

            You can further help your case by agreeing to continue to contribute your proportional share of the post secondary expenses (OR agreeing to direct the amount of support to your daughter directly for this purpose).

            You aren't wanting to cut them off completely, you just want to make sure your daughter finishes post secondary and has the financial means to do so

              I do plan to make gratuitous payments to my daughter to assist in her education.
