  • applying for divorce, before or after custody is ordered?

    When I filed for custody of my daughter I didn't want to file for divorce, so I filed in Family court. I knew at the time that I would have to either move the case if I wanted to file for divorce, or wait until the custody was settled before filing for divorce. Basically I didn't want to scare him into making it into a huge battle by filing for divorce as well ( guess that backfired on me).

    So can anyone give me some advice on next steps? I'm hoping that once we hear the OCL recommendations that we can settle custody and hopefully the financials will be easy (they are mostly settled except for a few small outstanding things).

    If I can get a SA signed covering everything can I transfer the case then or do I have to get an order for custody and then apply for the divorce?

    I do think "Family Court of the Superior Court of Justice" can handle the Divorce relief.

      The Government of Ontario links aren't responding for some reason. Here is an alternative link, scroll down and the links are there to the .pdf guides, it is all pretty self explanitory. If your other matters are settled, it is pretty much do-it-yourself, after all your other experiences it would be a piece of cake.
