  • Settlement Conference

    I have a settlement conference scheduled in less then a week and my ex the Applicant has failed to serve any documents for example a Form17C Settlement Conf Brief on me as per the family law rules. I should have had them last week. I will have my documents served on her in time but the whole point is the Applicant serves 7 days in advance and the Respondent serves 4 days prior this is so the Respondent can review the documents and prepare their defense before court. Has anyone been in this situation before? Not really fair that I have to abide by the rules and she doesn't. Will this just get thrown out of court and rescheduled.
    This has been going on for over a year. Our Case conference was last June. This is ridiculous. She knows she doesn't have a leg to stand on. She is collecting support for my one child who moved out months ago who will be turning 19 and not in school. I just want the money I'm paying to go to him. She is just avoiding the inevitable but I'm still paying. Oh we are also going to court for orthodontic expenses which are 100% covered and she has already been completely paid for???? What a waist of the courts time and mine. There needs to be a better system. I can't even get the FRO to stop enforcement on my claim until we go to court to change the Order. Just to note I have always paid my support she just registered me because I might not pay some day. What a system we have.

    i am not sure if it will get thrown out but look at it this way, if it goes ahead and all your ducks are lined up it will be on the way to being over no matter how much she tries to stall. To me I would not try to get it put over just because she has not filed her papers in the required time. There is a lot to be said for closure

        I would love to stop paying her and have the funds go to my son. To stop it I need an order from the Judge, but until we get to court and she is obviously trying to stall I have to keep paying. I filed a form with the FRO to discontinue support and have heard nothing back. I'm more than certain they will say go to court and get the order changed. Until that happens I keep paying I guess. I'm thinking I'm never going to get the money back I've been paying. What a system. I'm the one who pays and I'm the one who keeps getting screwed. The system is very broken.
