  • cc brief and lawyer

Is it common practise for the lawyer to fill out the brief and not forward a copy to you to review before you sign it?
Once again, got email from assistant asking me to come in tomorrow to sign and did not forward me a copy.
I asked them to. This happened with the reply as well and had made lots of changes as the lawyer made some big mistakes.

I always got a copy ahead of time for me to review, and I always had changes.

When you go in, take the brief to a conference room or a waiting room if it is a small office, and sit by yourself and read it over. Tell your lawyer to continue on with other work and not charge you for this time.

      Case Conference Information

Lawyers dont know enough factual things about your case to be filling out a case brief. I filled out my own, and then my lawyer went over it so it was "legally" correct. If she did it, I know there would of been tons of errors. You need to look out for yourself, lawyers can give legal advice but they know nothing about your marriage or your finances and they wont remember once you tell them either.

Furthermore, lawyers should remember who is paying for them. They have no right to do a court brief and just expect you to sign it before they file it. That is not right, this is your life, and they dont have the right to file such a document without giving you time to throughly go over it.

Dont file anything in court without reading it first, because once its filed it becomes gospel and hard to make amendments too.

Even case confernce briefs? There are tons of lies on those. I was under the impression that no one takes CCB seriously.

I give up!!!! CC brief was just a copy of all the things covered in application and reply!
No where was what I orginally wanted to do, is to propose my parenting plan.
And all I wanted to do was to show how I was/is a good parent, not trying to prove he is not a good one.

I feel you. It's frustrating. It seems teh whole system is designed for a mud slinging match. I was told "once you get in front of teh judges it changes". No it doesn't. They love the mud slinging and even take sides. No one seems to want a resolution and just push both sides to draw every signle last ounce of blood.

It's over when one of you decide it's over. Until then we are just puppets on a string. If I see another letter I will throw up.

I have finished the cc ( which I think is just bull) anyways, lawyer sent me cover letter to his lawyer and now sent me a list of things he wants me to email him. Isn't it too late to add things now to the cc?

I'll be so lucky if this cc date sticks. Ex having trouble now with 2nd lawyer.
Hum, makes me wonder why or is it just his bad luck?
What's going to happen now if he says he hasn't had time to prepare for this?

                      Anyone???

So, cc brief coming up, not sure if I should be doing anything else to prepare as Im not sure it will happen. I haven't done anything since I signed my cc brief and what should I be doing to prepare?
Questions I should be asking myself incase I get asked etc?
When will I find out if it's postponed? Then what is my next step?
Set another date? Do I have to go thru the whole process again? URRRRRR

I hope to have my current husband by my side during my case conference. However, my lawyer has told me that the other side must be in agreement to having him there.
Therefore, it is my understanding that, in order to have another party sit in on the case conference, everyone must be in agreement to them being there. You have the right to say, "No, I don't want them there." and they will not be allowed to stay.

Yes, my CC was in the court and unless privacy was requested the other cases were in the courtroom as well. My mom and sister both came with me. If you prefer to have the case closed to the "public" make sure you have a reason as is causes a delay.
