  • Cost of filing an application

    I'm getting ready to file an application for sole custody. I'll be representing myself. Is there a fee for filing the application??

    No fee. Make sure you talk to FLIC before you submit though.

        Family Law Information Centre - It's in every courthouse that handles family law cases. They give advice to those self-representing.

          There are duty councils that are in the courthouse to specificly advise self-representing on how to file, what forms, how to fill them out, making sure all the items are filled in properly, how many days notice for whatever. You should get as much info from the duty council first, because the FLIC lawyer is only supposed to advise you for 30 minutes.

          Get yourself sorted out as much as possible first, have a list of clear questions and be ready to take notes of the answers. Lay it all out in a step by step process and make yourself a checklist and a little calendar so you follow up with any needed forms or documents or supporting statements or whatever by the right date.

              yes, but it is something you have to do. I served my STBX yesterday after sitting on it for weeks. I didn't want to, but I need something stable for my child.

              It won't be that bad. Try to focus on the task and not yuor emotions. Take a book for the wait. It will help keep you calm

                Yeah, the problem is I STILL want to make him happy even though I know I can't. And filing with the court is going to make our strained relationship even worse. But you're right - I have to focus on why I'm doing this - which is for the kids, not him.

                  I feel the same way you do CSAngel but it's not about them anymore, it's all about the children! My ex has not given me child support for 10 months, won't get the house appraised and now is seeking shared custody for what I strongly feel is so he gets a deduction in CS. Sees his child 2-3 weeks at a time. Doesn't ask about her....etc...
                  Just got to focus on the children and do what you feel is in their best interest. I know mine is going to lose it when he gets the court papers...but it's not about him anymore (getting therapy to help me thru this and Im becoming a more stronger person!)
