  • inheritance part of settlement?

Hello, i joined nearly a year ago when my ex spouse left me for another woman and closed my bank account. Alot has passed since then but neither of us have been to court to make anything permanant. He has voluntarily paid child support at an amount set during an appointment with a FLIC lawyer. (the FRO is as yet not involved). A week ago, his mother was killed suddenly in a car crash and i am certain that he was named beneficiary in a life insurance policy. In a month, either of us will be able to file divorce proceedings. Am i permitted to ask for any of the amount he will be recieving in that policy? He left me with a large amount of debt on the line of credit that i am required to pay off. He has no intention of seeking custody of the children, and he seems quite secretive at the moment.

he should be required to pay half of the debt incurred on the line of credit before the separation date. You are also entitled to half of the money in the joint account he closed. All debts and all assets should be divided equally.

The inheritance is his though. You can't touch that.
