Trial - what costs in addition to lawyer fees?

  • Trial - what costs in addition to lawyer fees?

    Are there any other costs for a trial, aside from my own lawyer's fees (i.e. hourly charges, charges for affidavits etc)? This is assuming one has already gone though motion hearings, case conferences, settlement conferences etc.
    For example, are there any additional fees that would be paid to the court? Or any other types of fees?

    I believe there are also court costs.

      Administration of Justice Act - O. Reg. 417/95

      All I could find for Ontario Family Court...

      (a) proceedings under the Child and Family Services Act, the Children’s Law Reform Act, the Family Law Act (except Parts I and II), the Family Responsibility and Support Arrears Enforcement Act, 1996, the Marriage Act or the Interjurisdictional Support Orders Act, 2002; or

      (b) proceedings to enforce an order for support, custody or access made under any of these Acts. O. Reg. 417/95, s. 2; O. Reg. 15/00, s. 3; O. Reg. 137/04, s. 2.

        Sometime I hate the legal wording. It is so hard to really tell if there are court costs. I know there is your lawyer costs, maybe the otherside is awarded costs and you have to pay that, but the use of court space and judges and clerks time is that already covered adn we dont have to worry about it...oh my aching head

          Yeah.... I agree. I am pretty sure that the Government pays for everything except for the actual Lawyers fees.

                I am not exactly sure. From what my ex sister-in-law told me, during her divorce trial which lasted 4 straight days in court, in BC, she had to pay $3000 a day. IDK if her husband had to pay anything.

                Also, I think just to file for an appeal, it is $600.

                But I will ask my lawyer and let you know in a few days, to be sure.

                  There are no court fees. I was in court today to file a response and asked the counselor about it, she said all you pay is lawyer fees.

                    ...and possibly the lawyer fees and monies lost due to days off from work of the other party if they motion for costs.
