  • calculating child support

I wonder -- does the increased amount of child tax credit (Ontario) that I will receive once I'm filing income tax on my own (will go from $68 to approx. $190) get calculated into the support settlement? My ex and I had previously agreed to a specified amount of support, plus he would pay for half of any extra-curriculars for our daughter. Now, he's discovered that the child tax credit will increase for me eventually, and says that extra $ should mean he pays less.

I am 99% sure that it would not affect support amount. I know in my situation it doesn't.

      Parental Obligations

In my understanding of Child Support, the amount is based primarily on HIS income not YOURS. He is still responsible for the child financially based on what money he makes, therefore contributing to the raising of the child.

If I was a Judge, I'd be insulted by the implication that this "benefit" was being used as a change of circumstance to try get his support payments lowered!

I have to agree..even if you won Lotto 649 today it doesn't have any bearing on his Child support obligation, it is strictly calculated by his income alone and has nothing to do with you or your money.

As far as I can tell the only place where your income become relevant is in a claim for spousal support and the extraodinary expenses, as you pay on a proportional basis.

        Good luck!
