  • Example text for a Form 17A Case Conference Brief?

    I have been reluctant to post this request as otherwise I was hoping to trip across the answer somewhere within the 1126 pages of forum posts. I've spent the last 2 years reading most of those posts, including recently, and also via a 'Search' but nothing came up.

    In short, does anyone have a real (without private information) or contrived example of a Form 17A Case Conference Brief? I know that each will be unique to the case at hand but I'm looking to learn of the tone, wording and approach to take as I have not written one of these before.

    I also realize, from reading way too many forum postings, that judges (might) just ignore most of the text of the brief and ask "What issues have you resolved and what are remaining to be resolved?". Hence, I should not dwell on the brief all too much or make it too wordy.

    Somewhere in this forum I did come across a "Form 10A - Reply - Applicant - Simon Parker - 12-JAN-2023.pdf" a year ago which was useful in the past. It may be a practice document from elsewhere on the Internet.

    The following is this contrived example of a 17C settlement brief but I do not have an account to view it:

    It depends on the issues. You want to state the facts and not get into conjecture or what you think.

    For instance:

    The parties were married in x, separated in x and divorced in x. I am the applicant/respondent in the matter.

    There are x children of the marriage NAME BIRTH DATE ETC.

    The parties reached an agreement on x date. The agreement is attached at exhibit a.

    All child support monies have been paid and are current as of x date.

    NOW HERE IS WHERE IT GETS DIFFERENT…

    For support purposes:

    My current income has changed as of x date. I currently earn xxxxxxx. Child support is now x per month.

    The oldest child is attending school out of town. Child support is x per month for the months of May to August. As a result I have overpaid xxx.

    School expenses total xxxx. Xxx is allocated as the child's share with the remaining split xx/xx between the applicant and I. I have paid xxx to date for school expenses for an overpayment/underpayment of xxx.

    For parenting time purposes:

    The applicant/respondent and I agreed on a schedule of xxx. I am seeking to change this schedule to yyy.

    The applicant/respondent has not followed the parenting schedule set out in our agreement dated xxxx.



    And then add in what is needed. Stick to the facts. Don't get into he said she said. Don't use inflammatory language etc.

    Remember you are presenting your case so keep it short and simple. A judge doesn't want to read paragraphs about how crazy you think your ex is or how they lie etc.
