  • Trial sitting

    We have been on the trial list since early 2022 and still being bypassed for the last 3 trial sittings. What is the best approach to getting this trial done? Or are we just at the mercy of the court to call us? It is needless apprehension and planning for the last 3 times having to book time off work and care of the children only not to be called again and again.

    Can one request motion even when SC and TMC have been done and the trial form finalised?

    The court's mission is to get you to resolution in a reasonable timeline. This is that 3/4ish years for applications and 2 for mtc. You can get pushed when early and based on priority, but 3 times seems unreasonable. If you're being prejudiced by the delay, you may be able to get another interim order to prevent it. Talk to your case management judge; maybe you can separate the issues and possibly go through motion, but most likely you'll just have to wait for the next sitting.

      Thanks Stillpaying. It is just frustrating to say the least.
