  • So confused!

    My wife and I finally took the plunge and made a separation agreement. It was signed and witnessed. The next morning I was going to take it to my lawyer and she destroyed it saying she had changed her mind. I have rented an apartment with the intention of leaving. She seems to think that I'm staying put. My questions are am I entitled to remove those items that were willed to me? Specific items I purchased for my enjoyment (antique clock)? I don't want the house or furnishings...I have told her in leiu of child support I would continue with the mortgage until maturity (some 8-9 years) / taxes and insurance on the house and mortgage. I have bought her a new car replaced the appliances and the roof to the house. My boys are 15 and 18 and are established in the neighbourhood. I don't want to disrupt their lives anymore than I have to. Help please!

    I am not sure if you can make a deal with her in leiu of child support.Any items that were willed to you I would remove now. As for things purchased during the marriage, even if it was for just yourself, that is joint property.

    It seems like you are being more then fair so I really hope that she will be fair also.
