  • Marriage Contract Question

    I agreed to a marriage contract before my husband and I were married a few years ago, against the advice of my lawyer. I signed away my rights to the matrimonial home, along with other assets.
    In the event of a divorce, what is the likelihood of the courts overturning this agreement, as it is primarily one-sided?

    you signed it against the advice of your lawyer?? Cannot see the courts overturning it considering you had legal advice. If it was that easy then all contracts would not be enforcable therefore not worth the paper they are written on. Learn a good lesson with this, never go against legal advice and never sign something thinking that you can get out of it later.

      I would say that because you had legal representation but chose to go against his recommendation, then I would think a court would be hard pressed to alter the contract that you agreed to.

      Courts do reserve the right to alter any agreement if they feel that the content is grossly one sided AND/or one party was either forced to sign (under duress) or signed without legal representation.
      This is not the case with you, however, I would still seek legal advise on this as you never know. But like previously stated, what good would these agreements be if the courts simply overturned them at will without justification?
      No one would be “safe” if this were the case.
